1. Service Description

Welcome to mtdneuromalacia, a software-as-a-service (SaaS) platform provided by Domain. Our services include a suite of tools designed to enhance productivity and streamline operations for businesses of all sizes. By accessing or using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

mtdneuromalacia reserves the right to modify or discontinue the services at any time without prior notice. We will make reasonable efforts to notify users of significant changes, but it is your responsibility to review these Terms periodically for updates. Your continued use of the services after any changes constitutes your acceptance of the new terms.

Our services are intended for users located in Slovakia (SK) and are governed by the laws of Slovakia. By using our services, you represent that you are at least 18 years of age or have the consent of a parent or guardian to use our services.

2. User Accounts

To access certain features of our services, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify mtdneuromalacia immediately of any unauthorized use of your account or any other breach of security. mtdneuromalacia will not be liable for any loss or damage arising from your failure to comply with this section.

We reserve the right to suspend or terminate your account at our sole discretion if we suspect any violation of these Terms or any applicable laws. Upon termination, your right to use the services will immediately cease.

3. Acceptable Use Policy

By using our services, you agree to use them only for lawful purposes and in accordance with these Terms. You agree not to use the services:

4. Prohibited Activities

You are prohibited from engaging in any of the following activities while using our services:

  • Using the services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the services.
  • Using any robot, spider, or other automatic devices, process, or means to access the services for any purpose, including monitoring or copying any of the material on the services.
  • Introducing any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the services, the server on which the services are stored, or any server, computer, or database connected to the services.

Any violation of this section may result in legal action and/or termination of your account.

5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of mtdneuromalacia or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business use only. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted herein are reserved by Domain. Any unauthorized use of the services may violate copyright, trademark, and other laws.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services. By submitting any content, you grant mtdneuromalacia a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, translate, distribute, and display such content in any media.

You represent and warrant that you own or control all rights to the content you submit and that the content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights. mtdneuromalacia is not responsible for any content submitted by users and does not endorse any opinions expressed in user-generated content.

We reserve the right to remove or edit any user-generated content at our sole discretion and without notice.

7. Payment Terms

Access to certain features of the services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated in these Terms.

Payments will be processed through a third-party payment processor. You agree to provide accurate and complete payment information and authorize mtdneuromalacia to charge your payment method for the fees incurred. You are responsible for any taxes associated with your use of the services.

In the event of a payment dispute, you must contact us within 30 days of the charge. Failure to do so will result in the waiver of your right to dispute the charge.

8. Service Modifications

mtdneuromalacia reserves the right to modify or discontinue, temporarily or permanently, the services or any part thereof with or without notice. You agree that mtdneuromalacia will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any changes constitutes your acceptance of the new terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall mtdneuromalacia, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the services;
  • Any conduct or content of any third party on the services;
  • Any content obtained from the services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall mtdneuromalacia’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. mtdneuromalacia may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms or if we believe you are engaging in any conduct that violates applicable law or is harmful to other users or {{COMPANY_NAME}.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of your account does not relieve you of any obligations to pay any outstanding fees or charges incurred prior to termination.
